General conditions of sale Jobeeny limited

Definitions:

JOBEENY means Jobeeny Limited, a company (registered in England under number 6209643).

The Customer means the person, firm, company or partnership whose written order for the Goods is accepted by JOBEENY.

The Goods means the products which JOBEENY is to supply in accordance with these Terms.
Terms means the standard terms of sale set out in this document and includes any additional terms agreed in writing between JOBEENY and the Customer

Any orders that are placed by the Customer with JOBEENY are done so on the basis that the Customer accepts without reservation these Terms which override any other terms and conditions which may be stipulated at any time either orally or in writing. English Law will apply to all contracts between JOBEENY and the Customer.

JOBEENY reserves the right to withhold delivery of goods in the event of the Customer failing at any time to comply with these Terms (without prejudice to clause 12).

JOBEENY reserves copyright and full intellectual property rights on all products designed by JOBEENY, whether to the Customers order or otherwise.

JOBEENY reserves the right to make reasonable practical alterations to the Goods (at its sole discretion), unless such amendments are of a major nature and substantially alter the appearance or suitability of the Goods ordered by the Customer.

The Customer will determine the suitability of the Goods for their intended use at the time of order, and JOBEENY accepts no responsibility or liability arising should the Goods not prove satisfactory for such intended usage.
The price of the Goods will be as quoted on JOBEENY’s order confirmation or, where no price has been quoted, the price listed in the Seller’s published price list current at the date of acceptance of the order. Prices quoted exclude VAT and carriage charges.

Any clerical errors or omissions contained within any quotation, acknowledgement, confirmation or invoice submitted by JOBEENY will be rectified by JOBEENY on discovery and, as soon as practicable, notified to the Customer; such errors or omissions will not be binding on JOBEENY and rectification thereof will not invalidate the Contract.

In the event of orders placed by the Customer being cancelled, JOBEENY reserves the right to charge for all works undertaken including loss of profit where applicable.

Goods must be paid for in full prior to despatch, unless JOBEENY has given its prior written consent to alternate payment terms. Payments by cheque must be cleared before goods are dispatched. Compliance with JOBEENY’s payment Terms will be of the essence of the contract.

 

Guarantee

100% Guarantee All our fine products are guaranteed to be satisfactory. Should an item not meet your expectation, please return it in it's original condition within 30 days of it's receipt. We will promptly process your exchange or refund, as you instruct.The shipping and return costs are not refundable. Your statutory rights are upheld.

 

Availability

Product availability promise: With our original design we make every effort to keep all pieces of our collection in stock, but occasionally demand exceeds our limited edition supply. In some instances, the delivery time could exceed 30 days. We promise not to charge your credit/debit card until your items are ready to ship (cheques are necessarily banked upon receipt-please call if you wish to change your method of payment) You may cancel your order at any time before shipping by contacting us.Furthermore, in accordance with your statutory rights enhanced by our terms of trading, you may cancel it within 30 days of it's receipt by returning it to us (please see 100% Guarantee)

 

Delivery

International £15.00

International orders: Orders to non-UK destinations are subject to a £15.00 post and packing charge per order. Customers outside the EC will be liable for any relevant import duties or local taxes due upon receipt of their items.

 

Delivery of the Goods will be made by the by JOBEENY delivering the Goods to such place for delivery as is agreed by JOBEENY.

While all reasonable efforts will be made to meet any delivery dates given or requested these cannot be guaranteed by JOBEENY. Accordingly, delivery will not be of the essence of the contract and JOBEENY will not be responsible or liable for any losses whatsoever incurred by the Customer due to late delivery or delays.

JOBEENY reserves the right to supply Goods ordered in instalments. Where deliveries are made in instalments, each delivery will constitute a separate contract and failure by JOBEENY to deliver any one or more of the instalments in accordance with these Terms or any claim by the Customer in respect of any one or more instalments will not entitle the Customer to treat the contract as a whole as repudiated.

Risk of damage to or loss of the Goods will pass to the Customer at the time of payment for the Goods or, if payment has not been made prior to delivery, at the time when JOBEENY has tendered delivery of the Goods.

Until Goods are paid for in full, JOBEENY reserves the right of ownership and the Customer is liable for any loss or damage to such Goods. In the event of non-payment in breach of the payment Terms of JOBEENY, the Customer accepts that JOBEENY may repossess the said Goods directly without incurring trespass. The Customer will hold JOBEENY harmless for any consequential loss or damage should the said Goods be recovered directly from a third party. The Customer will be liable for any costs incurred by JOBEENY for the repossession of the above Goods.

Any claim by the Customer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification must be notified to JOBEENY within seven days from the date of delivery or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If the Customer does not notify JOBEENY accordingly, the Customer will not be entitled to reject the Goods and JOBEENY will have no liability for such defect or failure.

Except in respect of death or personal injury caused by JOBEENY’s negligence, or liability for defective products under the Consumer Protection Act 1987, JOBEENY will not be liable to the Customer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express Terms of the contract, for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of JOBEENY, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Customer, and the entire liability of JOBEENY under or in connection with the contract will not exceed the price of the Goods, JOBEENY will not be liable to the Customer or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of JOBEENY’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond JOBEENY’s reasonable control.
